EasyShare Privacy Terms

%3$s (hereinafter referred to as "we", or "us”) is the provider of EasyShare (the "Service") and the organization responsible for the personal data processed with respect to the Service. We care about your privacy and think it important that you know why and how we process your personal data. In the EasyShare Privacy Terms (the "Terms"), we therefore cover the following content:

Please read these Terms carefully and make sure that you have understood our practices regarding your personal data before you consent and start using the Service. You are not obliged to consent to the processing of your data with respect to the Service, but please be aware of the following: IF YOU DO NOT AGREE TO THESE TERMS OR IF YOU WITHDRAW YOUR CONSENT, YOU WILL NOT BE ABLE TO USE THE SERVICE.

1.  Collection and Processing

Data and purposes

•   EasyShare processes your SMS, contacts, calendar, images, video, audio, music, applications, settings, call records, notes, files or other contents stored in device (collectively, “Contents”) with algorithm on your device for the basic functions of one-touch device switch and backup restore. Please kindly note such personal data will only be processed locally on your device and will not be collected, accessed by us or be uploaded to our servers.

•   In the countries/regions where the mobile phone account function is available, EasyShare processes your mobile phone account information for the purpose of account information display if you have logged in the device.

•   EasyShare User Experience Improvement Plan: You can choose to participate in the EasyShare User Experience Improvement Plan voluntarily. If you choose to join, in order to improve our Service, we will collect the identifier of your device or application identifier, device model, device brand, Android system version, application version, usage behaviour in the application (e.g. browsing, clicking, etc.), country code and the error code when the application function does not work properly etc. Such analytical improvements will be carried out as a collection of data without identifying any personal identity or characteristics. You can at any time choose to turn off the button by going to Settings > Join EasyShare User Experience Improvement Plan within the EasyShare application. If you turn off this button, we will stop such processing in the Service until you re-agree. Please kindly note that this function may only be available on some certain devices due to device model, system version or region restrictions, subject to the actual availability. We will only process data under this function description if you enable or use this function.

We process the data for above purposes upon your consent to these Terms. And when allowed by applicable laws, other legal basis may be applicable in certain occasions as stated in Section 2 of our Privacy Policy. If you wish to not use all the functions of the Service, please withdraw your consent through the methods described in Section 4 of the Terms.

Security:

We care about protecting your personal data. We have put in place appropriate security measures, including but not limited to encryption and anonymization techniques, which are designed to protect your personal data from unauthorized use, damage, or loss. We will do our best to protect your personal data. If you suspect any unauthorized use, damage, or loss of your personal data, please let us know immediately using the contact details set out below.

2.  Storage

Period:

Data related to mobile phone account login and User Experience Improvement Plan will only be stored in our servers within necessary period for data processing. For other data, especially the Contents you use the Service to transfer, it will only be processed locally on your device and will not be collected, accessed by us or be uploaded to our servers. Meanwhile, we will retain:

•   Personal data related to the exercise of data subject rights, consents and customer interaction records for five years from your last interaction with us;

•   Backups and app logs processed for security purpose for no more than six months from the date they were created.

Once the retention period expires, we will delete or anonymise your personal data, unless otherwise required by applicable laws and regulations.

Location:

To provide the same level of data protection as that of the user's country/region and respond to users' requests more efficiently, the location where data is stored varies for users in different countries/regions. Please refer to the Storage and International Transfer section in our Privacy Policy to find out where your personal data is stored.

3.  Sharing and Transfer

Regarding the data uploading to the server, we will process your data by ourselves or by use of our affiliated companies or service provider(s) who act on our behalf. In addition, we will only share your data when required in response to a legal process or request from a competent authority according to applicable laws.

Since we operate internationally, and to make it possible for you to use our product worldwide, your personal data may be transferred to entities located in other countries/regions or accessed by them remotely. We comply with laws on the transfer of personal data between countries to help ensure your data is protected, wherever it may be.

4.  Your Rights

You have various rights with respect to the data which we hold about you.

Withdrawal of Consent:

You may at any time choose to withdraw your consent to our processing of your data by tapping the Withdraw consent button, which may be found under Privacy > Privacy Terms in the Profile of the Service. If you withdraw your consent, we will stop processing your data in the Service until you re-agree to these Terms.

Other Rights:

To exercise your other rights (such as rectification, erasure, restriction of processing, objection or data portability, depending on applicable data protection laws), please use the contact details set out below.

Complaint:

You have the right to lodge a complaint with a supervisory authority.
